An Anti-Corruption Guide on the Rights and Obligations of Persons Entrusted with Top Executive Functions (PTEFs), Public Officials and Civil Servants has been developed

In order to strengthen integrity, transparency, and accountability in the public sector, the Slovenian expert Dr Jure Škrbec, on the initiative of the Agency, has developed an Anti-Corruption Guide on the Rights and Obligations of Persons Entrusted with Top Executive Functions (PTEFs), Public Officials and Civil Servants.

The document will enable a better understanding of the rules applicable in the context of conflicts of interest, incompatibility of functions, asset declarations, gifts, whistleblower protection, lobbying, integrity plans, and transparency; it will reduce uncertainties caused by fragmented legislation and by-laws; and it will support the lawful, ethical, and integrity-based performance of public functions.

The document does not introduce new legal rules nor does it replace existing regulations, but rather consolidates relevant obligations in one place, clarifies their scope of application, and contributes to improved legal certainty and awareness of obligations arising from the anti-corruption normative framework. It applies to three main categories identified within the Montenegrin legal framework and GRECO recommendations: Persons Entrusted with Top Executive Functions, Public Officials under the Law on Prevention of Corruption, and Civil Servants and State Employees.

The Guide has been prepared in response to GRECO Recommendation V, with the aim of providing an overview of the rights, obligations, and responsibilities arising from the anti-corruption legal framework in Montenegro. Its preparation is aligned with Montenegro’s strategic anti-corruption framework, including the Anti-Corruption Strategy 2024–2028 and its Annex, which identifies the prevention of corruption among Persons Entrusted with Top Executive Functions as a specific risk area.

The preparation of the Guide represents an important step towards supporting lawful, ethical, and integrity-based performance of public functions, as well as further strengthening the resilience of institutions against corruption risks.
