The APC: School Board Members are not Public Officials

The Agency for the Prevention of Corruption (APC) hereby informs the public that, under the current Law on the Prevention of Corruption (Official Gazette of Montenegro 54/24), school board members do not have the status of public officials.
Oct. 3, 2024

After the most recent amendments to the General Law on Education (Official Gazette of Montenegro 84/24 of 6 September 2024), it has been clearly defined that school board members are not persons elected or appointed, which means that they do not fall within the scope of provisions of Article 3 of the Law on the Prevention of Corruption.

It is worth remembering that the APC has already withdrawn earlier decisions and interpretations according to which chairpersons and members of working bodies (such as commissions, councils and other bodies formed by state institutions and the Government) had the status of public officials.

We will continue with a detailed review of all previous decisions that led to an unfounded inclusion of a large number of persons in the records of public officials. Such “creative” interpretations of the law led to an unnecessary increase in the number of public officials, although there was no legal basis therefor.

The goal of the Agency is to reduce the number of public officials to a realistic and reasonable level, with a focus on the quality of work and the implementation of anti-corruption measures. Thus, we will ensure more efficient results and better effects of the anti-corruption measures implemented by the Agency.
