Analysis of procedures in the field of labor relations for the period from January 1, 2016 to December 1, 2022

Analyzing the previous performance as of December 1, 2022, the Section for Acting on Whistleblowers Reports and Whistleblowers Protection found that the largest number of procedures under its responsibilities, about 35 percent, are related to the field of labor relations. The analysis showed that most of these reports relate to the work of public companies owned by the state or municipality.

The reporting of cases of threats to the public interest that indicate the existence of corruption is part of the fundamental institutional mechanisms in strengthening the integrity of the public and private sectors, and the affirmation of ethical values ​​and standards, and, as such, is a pillar of the preventive anti-corruption system.

Recognizing this area as particularly important in the scope of its activities, the Agency for Prevention of Corruption has, since the beginning of its work, on January 1, 2016, encouraged citizens to report corrupt acts by providing them with institutional protection, with a deep awareness of the importance and delicacy of the whistleblower's role in developing an environment of responsibility and transparency, and strengthening trust in the work of public administration.

Analyzing the previous performance as of December 1, 2022, the Section for Acting on Whistleblowers Reports and Whistleblowers Protection found that the largest number of procedures under its responsibilities, about 35 percent, are related to the field of labor relations. The analysis showed that most of these reports relate to the work of public companies owned by the state or municipality.

Out of a total of 257 procedures related to labor relations (establishment of employment relationship, termination of employment relationship, abuse of rights arising from work and based on work, and so on), so far in 48 cases it has been established that there is a threat to public interest that indicates the existence of corruption. The Agency gave recommendations for eliminating corruption risks to all institutions where it found the existence of threats to the public interest which indicate the existence of corruption. The degree of implementation of given recommendations is over 95%.

In addition, acting preventively and proactively, the Agency made 494 recommendations aimed at improving transparency and eliminating corruption risks in employment procedures at 121 institutions.

Dedicated to the protection of the public interest, the Agency for Prevention of Corruption will continue to monitor the situation in the field of labor relations in the following period in public companies, public institutions and other legal entities whose majority owner or founder is the state or municipality, as well as in state bodies and other institutions to which the Law on Civil Servants and State Employees applies.
